Terms and Licence Agreement

This agreement is between you and Alexey Erenkov, an individual trading as TrafficWeaver, of Dubai, United Arab Emirates ("we", "us"). It covers the TrafficWeaver application, its system extension and this website. By installing or using the software you accept it. If you do not accept it, do not install the software.

1. What you are buying

A licence to use the software. The software is licensed, not sold, and we keep ownership of it and of all intellectual property in it.

2. Scope of the licence

A standard licence lets one named person install and use the software on up to two Macs that they personally use. A licence bought by an organisation covers the number of machines stated on the invoice, used by that organisation's personnel.

Licences may be bound to a machine fingerprint and may limit the number of active machines. You can release a machine yourself in the application, and machines inactive for 90 days are released automatically.

3. Term, updates and what happens if you stop renewing

The licence is perpetual: the versions you are entitled to keep working indefinitely, with no expiry date and no requirement to remain connected to the internet.

A purchase includes updates released within one year of purchase. You may extend that period by paying the renewal price shown on the pricing page. If you do not renew, you keep using the last version released within your entitlement period; you simply do not receive later versions. Security fixes for versions you are entitled to are not withheld for non-payment.

4. Trial

The trial gives full functionality for the stated period. When it expires the software stops routing traffic. It is provided as-is, and one trial per machine is intended.

The software routes your own network traffic on machines you control. You agree not to use it:

You are responsible for the proxy servers you configure and for complying with the laws that apply to you. We operate no proxy servers and provide no network service.

7. Export control and sanctions

You confirm that you are not located in, under the control of, or a national or resident of any country subject to comprehensive trade sanctions applicable to us, and that you are not on any restricted-party list. You will not export, re-export or make the software available in breach of applicable export control or sanctions law.

Our handling of personal data is described in the Privacy Policy, which forms part of this agreement.

9. Third-party components

The software includes open-source components used under their own licences, including the Sparkle update framework (MIT). A complete list with licence texts is shown in the application under Settings, and is available on request.

10. Warranty disclaimer

The software is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted or error-free, or that it will work with every proxy server, application or macOS version.

This software runs with elevated privileges and handles network connections. You are responsible for evaluating whether it is suitable for your environment and for maintaining your own backups and continuity arrangements.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost data, business interruption, or the cost of substitute software, however caused and on any theory of liability. Our total liability under this agreement is limited to the greater of the amount you paid for the licence in the twelve months before the event giving rise to the claim, or the price you originally paid for the licence.

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

12. Consumer rights

If you buy as a consumer, you have statutory rights that this agreement does not affect. Where the law of your country of residence gives you stronger rights than this agreement, those rights apply.

14. Termination

This licence ends if you materially breach it and do not remedy the breach within 14 days of being asked to. On termination you must stop using the software and remove it. Sections 5 to 11 survive termination. If we terminate a licence without cause, we refund the unused portion of any update entitlement.

15. Changes to these terms

We may update these terms for future purchases and for material changes to the software. The terms that apply to your licence are the ones published when you bought it, unless a change is needed to comply with the law. Material changes are announced on this page and in the application.

16. Governing law

This agreement is governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction, except that if you are a consumer resident elsewhere you may also rely on the mandatory consumer protection law and courts of your country of residence.
